La.R.S.42:1102(21)defines"Substantial economic interest'to mean an economic interest which <br /> is of greater benefit to the public servant or other person than to a general class or group of <br /> persons... <br /> La. R.S.42:1153(6)provides with respect to any penalties: <br /> Upon a determination that any public employee or other person has violated any <br /> provision of any law within the jurisdiction of the Board of Ethics except violations of <br /> the Campaign Finance Disclosure Act which shalt be governed by Chapter I l of"rule <br /> 18 of the Louisiana Revised Statutes of 1950, the Ethics Adjudicatory Board may <br /> remove, suspend, or order a reduction in pay, or demotion of the public employee or <br /> other person, or impose a fine of not more than ten thousand dollars. or both. <br /> V. <br /> OPINION: <br /> Alton McClinton was a public servant as defined by the Code during his employment at <br /> Jefferson Parish Department of Inspection and Code Enforcement. Alton McClinton had certain <br /> duties and responsibilities while he was Building Inspector between August 8, 2013 and January <br /> 30. 2019. As such. Alton McClinton, was responsible for collecting annual monetary dues and <br /> conducting fundraisers for the cheer team. Alton McClinton improperly received compensation of <br /> not less than $3,000.00 as Building Inspector. <br /> It is the opinion of the BOE that Alton McClinton, in his capacity as Building Inspector of <br /> Jefferson Parish Department of Building and Code Enforcement, violated La. R.S. <br /> 42:1111(A)(1)(a)and La. R.S. 42:1 l 12(A)when he solicited and received not Tess than $3,000.00 <br /> in compensation which he was not duly entitled to receive for the performance of his duties and <br /> responsibilities as Building Inspector from 2013 to 2019. <br /> Page 5 of 9 <br />
