Ethics Board Docket No. 2014-1278 <br /> Page 2 of 10 <br /> 2. <br /> The BOE is authorized to offer a Consent Opinion by virtue of Section 1141C(3)(f) of the <br /> Ethics Code. <br /> III. PROCEDURAL HISTORY <br /> 3. <br /> On November 20, 2015, the BOE filed Charges against Respondents for potential <br /> violations of La. R.S. 42:1112 and 1113 in Docket No. 2015-14943-ETHIC S-B before the EAB at <br /> the Division of Administrative Law. <br /> 4. <br /> On May 31, 2016, the Respondents filed a Reconventional Demand for Declaratory <br /> Judgment and Injunction in the 19th Judicial District Court in Docket No. 648379, which was <br /> assigned to Division D, Section 21. <br /> 5. <br /> On June 13, 2016, Respondents filed a Motion for Summary Judgment before the EAB <br /> asserting that they were not public servants for the purposes of the Ethics Code. On November 3, <br /> 2016,the EAB issued an Order denying the Respondents' Motion for Summary Judgment, finding <br /> that the matter should proceed to hearing. <br /> 6. <br /> On November 16, 2016, Judge Janice Clark at the 19`h Judicial District Court issued a <br /> Judgment granting the Respondents' Preliminary Injunction, finding that Respondents were not a <br /> public servant, and thereby enjoining the BOE from pursuing enforcement of the Charges. <br />
