La. R.S. 42:1102(16) defines "person" to mean an individual or legal entity other than a <br /> governmental entity, or an agency thereof. <br /> La. R.S. 42:1102(18)(a) def�ines"public einployee" to�nean anyone, whether compensated or not, <br /> who is: <br /> (i) An administrative ofticer or official of a governmental entity who is not �611ing an elective <br /> oFfice. <br /> (ii) Appoi�lted by any elected ofi7cial when acting in an official capacity, and the appointment is <br /> to a post or position wherein t11e appointee is to serve the governmental entity or an agency therco�, <br /> eithcr as a member of an agency, or as an employee thereof. <br /> (iii) E�Z�;aged i,n t17e per�Iormance of a governmental function. <br /> (iv) tlnde�• the supervision or authority of an elected official or another employee of the <br /> gover�iniental e�ltity. <br /> La. R.S. 42:1102(l9) dEfines "public servant" as a public employee or an elected ofiicial. <br /> La. R.S. 42:1102(20.1) detines "service" to mean the performance of work, duties, <br /> responsibilities, or tlie leasing, rental, or sale of movable or immovable property. <br /> La. R.S. 42:1102(23) defincs "transaction involving the governmental entity" to mean any <br /> proceeding, application, submission, request for a ruling or other determination, contract, claiin, <br /> case, or other such particular inatter which the public servant or former public servant of the <br /> governmental entity in question knows or should know: (a) Is, or will be, the subject of action by <br /> tl�e�overnmental entity. (b)Is one to which tlle governmental entity is or will be a part.y. (c) Is oi�e <br /> in which the governmental entity has a direct interest. A transaction involving the agency of a <br /> governmet�tal entity shall have the same meauing with respect to the agency. <br /> ANALYSIS <br /> In your capacity as the Injection and Mining Division Director, you were a "public employee" <br /> pursuant to I,a. R.S. 42:1102(1$) and a "public servant" pursuant to La. R.S. 42:1102(19). Your <br /> agency was t:he Injection and Mining Division pursuant to La. R.S. 42:1 l 02(2)(a)(i), and you were <br /> an agency head pursuant to La. R.S. 42:1102(3 j. The State of I,ouisiana was your governmental <br /> entity pursuant to La. R.S. 42:1102(12). <br /> As the former agency head of the Injection and Mining Division, La. R.S. 42:1 121A(1) prohibits <br /> you, for a period of two years following your retirement from public service on January l 1, 2025, <br /> from assisting another person for compensation in a transaction or in an appearance in connection <br /> with a transaction involving the Injection and Mi»ing Division, or from rendering any service on <br /> a contractual basis to or for the lnjection and Mining Division. <br /> �s a former public employee, La. R.S. 42:1121B(1) prolvbits you, for a period of two years <br /> following your retirement from public employment on January 11, 2025, froin assisting another <br /> person for compensation in a transaction or in an appearance in connection with a transaction, in <br /> which you participated at any time during your public employinent and involving the State of� <br /> I,ouisiana.
