411 ETHICS BOARD <br /> OPINION NO. 92 -088 <br /> PAGE 2 <br /> Considering the allegations contained in the complaints, <br /> the information submitted by the respondents and, the remedial <br /> actions that were voluntarily taken prior to the commencement of <br /> this investigation, it is appropriate to dispose of this case by <br /> the issuance of this opinion': <br /> I. <br /> THE CODE <br /> The Code of Governmental Ethics ( "the Code "), generally at <br /> LSA -R.S. 42:1101, 21 seq., contains provisions prohibiting public <br /> servants from accepting or otherwise being reimbursed for travel <br /> and lodging under specified circumstances and from specified <br /> sources. The applicability of specific provisions depends upon <br /> the office to which an official is elected. <br /> Section 1111A prohibits public servants, including elected <br /> officials, from accepting "any thing of economic value," from a <br /> nonpublic source, "for the performance of the duties and <br /> responsibilities of his office or position." <br /> Section 1115A prohibits elected officials, and other public <br /> servants, from accepting a "thing of economic value" as a gift or <br /> 1 The respondents, in accordance with R.S. 42:1141(13), have made <br /> written requests to the Board which permit the publication of this <br /> opinion without regard to the confidential nature of investigations <br /> and private hearings. <br />
