• ETHICS BOARD <br /> OPINION NO. 92 -088 <br /> PAGE 3 <br /> gratuity, from any person, or that person's officer, director, <br /> agent, or employee, if that person: <br /> 1) has or is seeking to obtain contractual or other <br /> business or financial relationships with the public <br /> servant's agency, or <br /> 2) is seeking, for compensation, to influence the passage <br /> or defeat of legislation by the public servant's agency. <br /> R.S. 42:1102(2)(b) defines the "agency" of the Governor as <br /> the executive branch of state government. R.S. 42:1102(2)(d) <br /> defines the "agency" of a legislator as the legislative branch. <br /> R.S. 42:1102(2)(f) defines the "agency" of a mayor and council <br /> members as the city. <br /> • R.S. 42:1102(22)(a) defines "thing of economic value" as: <br /> "Thing of economic value" means money or any <br /> other thing having economic value, except <br /> promotional items having no substantial resale <br /> value; food, drink, or refreshments consumed by a <br /> public servant, including reasonable <br /> transportation and entertainment incidental <br /> thereto, while the personal guest of some person, <br /> and, with reference to legislators only, <br /> reasonable transportation when organized <br /> primarily for educational or informational <br /> purposes, including food and drink incidental <br /> thereto, . . . <br /> The exclusion from the definition of "thing of economic <br /> value" of "reasonable transportation when organized primarily for <br /> educational or informational purposes, including food and drink <br /> incidental thereto ", applies only to legislators.
