Ethics Board Docket No. 2022-062 <br />Page 8 of 12 <br />LY <br />OPINION: <br />It is the opinion of the BOE that each of Gordon Atwell and Ashley van der Meulen, in <br />their capacities as members of the LSBHI violated Section 1111 C(2)(d) of the Ethics Code by <br />virtue of receiving compensation for providing continuing education services to persons who <br />conduct operations or activities which are regulated by the LSBHI. Section 1111 C(2)(d) of the <br />Ethics Code prohibits members of the LSBHI from receiving compensation for providing <br />continuing education classes to persons who are regulated by the LSBHI. Members of the LSBHI <br />are public employees within the agency of the LSBHI, and persons obtaining continuing education <br />credit are regulated by the LSBHI. <br />It is the opinion of the BOE that each of Gordon Atwell and Ashley van der Meulen, in <br />their capacities as members of the LSBHI, violated Section 1113B of the Ethics Code virtue of his <br />application to the LSBHI for approval to be a continuing education provider. Section 1113B of the <br />Ethics Code prohibits members of the LSBHI from applying to be continuing education providers, <br />as the submission of such an application represents a transaction with LSBHI. <br />Each of Gordon Atwell and Ashley van der Meulen, while serving as a member of the <br />LSBHI, submitted applications to be continuing education providers and received compensation <br />for providing continuing education classes. <br />If this matter proceeded to a public hearing before the Ethics Adjudicatory Board, and the <br />Ethics Adjudicatory Board found a violation of the Ethics Code, the Ethics Adjudicatory Board <br />could impose a fine of up to $10,000 for each violation of the Ethics Code, pursuant to Section <br />1153B of the Ethics Code. The Ethics Adjudicatory Board could also impose penalties equal to <br />one -and -a -half times the amount of economic advantage gained, pursuant to Section 1155A of the <br />
