Penalties <br /> A. If an investigation conducted pursuant to this Part reveals that any public servant <br /> or other person has violated any law within the jurisdiction of the Board of Ethics to <br /> his economic advantage, and after an adjudicatory hearing on the matter,the Ethics <br /> Adjudicatory Board may order the payment of penalties. Recovery may include, in <br /> addition to an amount equal to such economic advantage,penalties not to exceed one <br /> half of the amount of the economic advantage. <br /> V. <br /> OPINION: <br /> It is the opinion of the Board that Robert McGarner violated La. R.S. 42:1121 by virtue of <br /> his employment with GEO Foundation and assistance to GEO Foundation in transactions with GEO <br /> Academies EBR within two years of the termination of his service as a member of the GEO <br /> Academies EBR Charter School Board. <br /> As an appointed member of the GEO Academies EBR Charter School Board, Mr. McGarner <br /> was subject to the provisions of Code of Governmental Ethics pursuant to La. R.S. 17:3996B(20). <br /> Further, he was an agency head as defined by La. R.S. 42:1102(3). His agency, as defined by La. <br /> R.S. 42:1102(a)was GEO Academies EBR and all of the schools under its jurisdiction pursuant to <br /> the Charter School Contracts between GEO Academies EBR and the Board of Elementary and <br /> Secondary Education. <br /> GEO Foundation is a person as defined by La. R.S. 42:1102(16) as it is a private nonprofit <br /> organization. <br /> As an agency head and member of a board or commission, Mr. McGarner was prohibited <br /> from receiving a thing of economic value for assisting a person in transactions involving his former <br />
