Penalties A. If an investigation conducted pursuant to this Part reveals that any public servant or other person has violated any law within the jurisdiction of the Board of Ethics to his economic advantage, and after an adjudicatory hearing on the matter,the Ethics Adjudicatory Board may order the payment of penalties. Recovery may include, in addition to an amount equal to such economic advantage,penalties not to exceed one half of the amount of the economic advantage. V. OPINION: It is the opinion of the Board that Robert McGarner violated La. R.S. 42:1121 by virtue of his employment with GEO Foundation and assistance to GEO Foundation in transactions with GEO Academies EBR within two years of the termination of his service as a member of the GEO Academies EBR Charter School Board. As an appointed member of the GEO Academies EBR Charter School Board, Mr. McGarner was subject to the provisions of Code of Governmental Ethics pursuant to La. R.S. 17:3996B(20). Further, he was an agency head as defined by La. R.S. 42:1102(3). His agency, as defined by La. R.S. 42:1102(a)was GEO Academies EBR and all of the schools under its jurisdiction pursuant to the Charter School Contracts between GEO Academies EBR and the Board of Elementary and Secondary Education. GEO Foundation is a person as defined by La. R.S. 42:1102(16) as it is a private nonprofit organization.
