Ethics Board Docket Nos. 2023-661 <br /> Page 8of12 <br /> agency for a period of two years following the termination of service of the agency head/board or <br /> commission member.Therefore,Robert McGarner's receipt of income for assisting GEO Foundation <br /> with its contractual obligations with GEO Academies within two years of the termination of his <br /> service on the GEO Academies EBR Board of Directors violated La. R.S. 42:1121A. <br /> If this matter proceeded to a public hearing before the Ethics Adjudicatory Board, and the <br /> Ethics Adjudicatory Board found a violation of the Code of Governmental Ethics, the Ethics <br /> Adjudicatory Board could impose a fine of up to $10,000 for each violation of the Code. Further, <br /> an additional penalty in an amount not to exceed one and one half times of the economic advantage <br /> could be assessed. In this particular situation, it is the conclusion of the Board that the interest of <br /> the public would be served by,and the parties have agreed to resolving this matter amicably through <br /> the publication of this Consent Opinion with the imposition of a$5,000 civil penalty against Robert <br /> McGarner. <br />
